General terms and conditions Uncovered. Cosmetics
Article 1 - Definitions
In these terms and conditions the following terms shall have the following meanings:
- Webshop: Uncovered. Cosmetics, which acts as an agent between suppliers and consumers
- Platform: the website and/or application on which Uncovered. Cosmetics offers its services;
- Supplier: the party that offers cosmetic products through Uncovered. Cosmetics;
- Consumer: the natural person who is not acting for purposes relating to his trade, business, craft or profession and who enters into a distance contract with a Supplier via Uncovered. Cosmetics;
- Distance contract: an agreement concluded between the Supplier and the Consumer via the Platform of Uncovered. Cosmetics;
- Reflection period: the period within which the Consumer can make use of his right of withdrawal;
- Right of withdrawal: the possibility for the Consumer to cancel the distance contract within the cooling-off period;
- Day: calendar day;
- Durable medium: any instrument which enables the Consumer or Uncovered. Cosmetics to store information addressed personally to him in a way accessible for future consultation or use for a period of time adequate for the purposes of the information and which allows for the unchanged reproduction of the stored information.

Article 3 - Applicability and role as mediator
- These general terms and conditions apply to every offer made via the Uncovered. Cosmetics platform and to every distance contract concluded between supplier and consumer in which Uncovered. Cosmetics acts as an intermediary.
- Uncovered. Cosmetics acts exclusively as an intermediary between suppliers of cosmetic products and consumers. Uncovered. Cosmetics is not a party to the purchase agreement that is concluded between the supplier and the consumer.
- As a mediator, Uncovered. Cosmetics facilitates the conclusion of agreements, but is not responsible for the execution of these agreements.
- Before the distance contract is concluded, the text of these general terms and conditions will be made available to the Consumer. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions can be viewed at Uncovered. Cosmetics and that they will be sent to the Consumer free of charge as soon as possible upon request.
- If the distance contract is concluded electronically, notwithstanding the previous paragraph and before the distance contract is concluded, the text of these general terms and conditions may be made available to the Consumer electronically in such a way that the Consumer can easily store it on a durable data carrier.
Article 4 - The offer
- The offer on the Uncovered. Cosmetics platform contains a transparent and honest description of the products offered, based on the information provided by the suppliers.
- Uncovered. Cosmetics is not the manufacturer or seller of the offered items. All product information is provided by the suppliers.
- Uncovered. Cosmetics uses a transparent methodology for assessing and comparing products, based on a checklist and additional characteristics. This methodology may be adjusted in the future.
- Each offer contains such information that it is clear to the Consumer what rights and obligations are associated with accepting the offer.
Article 5 - The Agreement
- The agreement is concluded between the supplier and the consumer at the time the consumer accepts the offer and meets the conditions set therein.
- Uncovered. Cosmetics shall immediately confirm receipt of acceptance of the offer electronically on behalf of the supplier.
- Uncovered. Cosmetics takes appropriate technical and organizational measures to secure the electronic transfer of data and ensures a secure web environment.
Article 6 - Right of withdrawal
- The consumer can cancel an agreement regarding the purchase of a product during a reflection period of 14 days without giving any reason.
- The cooling-off period commences on the day after the consumer, or a third party designated by the consumer in advance, who is not the carrier, has received the product.
Article 7 - Obligations of the consumer during the cooling-off period
- During the cooling-off period, the consumer will handle the product and packaging with care. He/she/they will only unpack the product to the extent necessary to determine the nature and characteristics of the product.
- If the seal is broken, the right of withdrawal lapses.
Article 8 - Exercise of the right of withdrawal
- If the consumer exercises his/her right of withdrawal, he/she/they must report this within the cooling-off period to Uncovered. Cosmetics, who will then inform the supplier.
- The consumer shall bear the direct costs of returning the product to the supplier.
Article 9 - Obligations in case of withdrawal
- In case of revocation, the supplier will refund all payments of the consumer, without delay but within 14 days. Uncovered. Cosmetics will facilitate this process.
- If Uncovered. Cosmetics makes it possible for the Consumer to notify the withdrawal electronically, it will immediately send a confirmation of receipt after receiving this notification.
Article 10 - The price
- The prices listed on the platform are the prices as recommended by the suppliers. Uncovered. Cosmetics has no direct influence on these prices.
- During the period of validity stated in the offer, the prices of the products and/or services offered will not be increased, except for price changes due to changes in VAT rates.
- The prices stated in the offer of products or services include VAT.
Article 11 - Liability
- As an intermediary, Uncovered. Cosmetics is not responsible or liable for damage caused by products or for misleading information about products. The responsibility for this lies with the supplier of the product.
- In the event of damage or misleading information, Uncovered. Cosmetics will put the consumer in contact with the relevant supplier to resolve the issue.
- Uncovered. Cosmetics accepts no liability for indirect damage, including but not limited to consequential damage, lost profits, lost savings and damage due to business stagnation.
Article 12 - Delivery and execution
- The supplier is responsible for the delivery of the products. Uncovered. Cosmetics only facilitates the communication between supplier and consumer.
- The place of delivery is the address that the consumer has provided to Uncovered. Cosmetics.
- Subject to the provisions of Article 4 of these general terms and conditions, the Supplier will dispatch accepted orders as soon as possible.
Article 13 - Complaints procedure
- Complaints about the performance of the agreement must be submitted within a reasonable time to Uncovered. Cosmetics, who will submit and discuss them with the supplier concerned.
- Uncovered. Cosmetics will endeavor to obtain a response from the supplier within 10 working days and pass it on to the consumer.
- Complaints submitted to Uncovered. Cosmetics will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, Uncovered. Cosmetics will answer within the period of 14 days with a confirmation of receipt and an indication of when the Consumer can expect a more detailed answer.
Article 14 - Disputes
- Agreements between suppliers and consumers that are concluded via the Uncovered. Cosmetics platform are exclusively governed by Dutch law.
Article 15 - Additional provisions
- Uncovered. Cosmetics reserves the right to enter into partnerships with other 'green' brands for co-branding purposes.
- Suppliers are responsible for providing truthful product information and must voluntarily provide evidence upon request.
- Uncovered. Cosmetics reserves the right to negotiate a distribution contract with suppliers.
Article 16 - Amendment of the general terms and conditions
- Uncovered. Cosmetics reserves the right to change or supplement these general terms and conditions.
- Changes also apply to agreements already concluded, taking into account a period of 30 days after publication of the change on the website of Uncovered. Cosmetics or by electronic message. Changes of minor importance can be implemented at any time.
- If the Consumer does not wish to accept a change to these terms and conditions, he may terminate the agreement up to the date on which the new terms and conditions come into effect, either by this date or on the date of receipt of the termination if this is after the effective date of the change.
These general terms and conditions have been drawn up in accordance with Dutch law and the guidelines for e-commerce.
